EVER WONDERED HOW LONG YOU MUST WAIT TO OBTAIN A NEW MORTGAGE?

If you’ve filed bankruptcy, gone through a short sale or had a home foreclosed, the following timelines broken down by loan program will give you a snap shot of how long it may take before you are eligible to obtain a mortgage.

 

CONVENTIONAL – (FANNIE MAE/FREDDIE MAC) – DETERMINED BY DATE OF APPLICATION

DEROGATORY ITEM

WAITING PERIODS

FORECLOSURE House was given back to the bank – No owner participation.

  • 7-years from the date the foreclosure was completed and the property was transferred back to the bank and there were no extenuating circumstances.
  • 3-years from the date the foreclosure was completed and the home was transferred back to the bank with acceptable extenuating circumstances.  A 10% minimum down payment is required on a Primary home purchase and rate/term refinance only. Non-owner and second homes are not allowed.

An automated underwriting approval is required, no manual underwrites.

SHORT SALEDEED IN LIEU OF House was sold but sales price didn’t cover the amount owed.House was returned to the Lender in exchange for a cancellation of the loan.

  • 7-years from the date the sale closed and title transferred to the new owner or transferred back to the bank – less than 10% down payment.
  • 4-years from the date the sale closed and transferred to the new owner or transferred back to the bank  – 10% down payment.
  • 2-years from the date the sale closed and transferred to the new owner or transferred back to the bank –  20% down payment.
  •  2-years from the date the sale closed and transferred to the new owner or transferred back to the bank allowed with acceptable extenuating circumstance – 10% down payment.

An automated underwriting approval is required, no manual underwrites.

BANKRUPTCY – CHAPTER 7 Debts are discharged through bankruptcy without  a debt repayment plan.

  • 4-years from discharge date.
  • 2-years from discharge date possible with acceptable extenuating circumstance.

  • 2-years from discharge date.

SHORT SALE House was sold but sales price didn’t cover the amount owed.

  • 3-years from the date the sale closed and title transferred to the new owner.
  • No waiting period if the Borrower had no late payments on any mortgage or consumer debt within the 12-months preceding the short sale AND they are not taking advantage of declining market conditions.
BANKRUPTCY – CHAPTER 7 Debts are discharged through bankruptcy without a debt repayment plan.

  • 2-years from the date of discharge with re-established credit paid as agreed or no new credit obligations incurred.
  • 12-months to 2-years from the discharge dateif acceptable extenuating circumstances and the Borrower has since exhibited a documented ability to manage their financial obligations responsibly.
BANKRUPTCY – CHAPTER 13 Debts are discharged through bankruptcy without  a debt repayment plan.

  • 1-YEAR payment period under the bankruptcy payment plan has elapsed and the Borrower’s payment performance has been satisfactory with all payments made on time and the Court’s agreement that they are able to incur new debt.

VA – DETERMINED BY DATE OF CREDIT APPROVAL

DEROGATORY ITEM

WAITING PERIODS

  • 2-years from the date the foreclosure was completed and transferred back to the bank.

SHORT SALE House was sold but sales price didn’t cover the amount owed.

  • 2-years from the date the sale closed and title transferred to the new owner.
  • No waiting period if Borrower had no late payments on their mortgage or consumer debt within the 12-months preceding the short sale AND they did not take advantage of declining market conditions.

  • 3-years from the discharge date.
  • Less than 3-years from the discharge date may be considered with acceptable extenuating circumstances.
BANKRUPTCY CHAPTER 13 Debts are discharged through bankruptcy without  a debt repayment plan.1-YEAR payment period under the bankruptcy payment plan has elapsed and the Borrower’s payment performance has been satisfactory with all payments made on time and the Court’s agreement that they are able to incur new debt.

Extenuating circumstances must be documented and verified, typically through a third party.  Examples of acceptable extenuating circumstances are as follows:

Conventional loans – non-recurring events that are beyond the Borrower’s control that result in a sudden, significant and prolonged reduction in income or a catastrophic increase in financial obligations.

FHA – Serious illness or death of a wage earner.  Divorce and the inability to sell a property due to a job transfer or relocation to another area does not qualify as an acceptable extenuating circumstance.

VA – Unemployment, prolonged strikes, medical bills not covered by insurance, etc.  Divorce is not viewed as beyond the control of the Borrower and/or spouse.

USDA – Loss of job, delay or reduction in Government benefits or other loss of income, increased expenses due to illness, death, etc.  Circumstances surrounding the adverse information must have been temporary in nature, and beyond the applicant’s control, and have been removed so their reoccurrence is unlikely or the adverse action or delinquency was the result of a refusal to make full payment because of defective goods or services or as a result of some other justifiable dispute relating to the goods or services purchased or contracted for.

  3. Each and every time I attempt to access the blog, this message comes up: “403 Forbidden – You don’t have permission to access / on this server. Additionally, a 500 Internal Server Error error was encountered while trying to use an ErrorDocument to handle the request.” I’ve never came across a situation like this before; is this through some wrong doing of mine, or perhaps there something wrong with the website itself?

  4. This page has been performing ok but all of the sudden when i go on it i receive this text: Proxy Error The proxy server received an invalid response from an upstream server. The proxy server could not handle the request GET /. Reason: Error reading from remote server Can anyone inform me what it really means and ways to correct it please! with thanks

    • Thank you for your question! When starting your own blog you need to choose a blogging site that works best for you. I did some research and found WordPress to be best suited for me and what I am trying to accomplish. I myself don’t like dealing with the technical side of things, but WordPress is a user-friendly site and I have learned how to use it quickly. Even though it works best for me, it might not be exactly what you are looking for. My advice to you would be to research other blogging sites to find the perfect one for you.     • Thank you for your questions! WordPress offers many great themes for you to choose from when creating your blog. I am using the Fluer de Lys theme, but upgraded to the WordPress Value Bundle to have more freedom to personalize how I want my blog to look. Coding expertise is not required, but it does help if you are looking to customize a particular theme. WordPress offers great resources through their forums and technical support for CSS and html coding. I hope this was helpful! Good luck creating your blog!

There are many learners who are simply just trying to pull through and have an extended or favourable credit history are often a difficult issue to have.
